Website Terms of Use

These Terms of Use govern your access and use of The College of Immigration and Citizenship Consultants’ (the “College”) website (the “Site”). By accessing this Site, you agree to be bound by these Terms of Use. The College may revise these Terms of Use at any time. We encourage you to review these Terms of Use from time to time to view any changes made. Your continued use of the Site will signify your continued acceptance to any revisions or updates.

Site Usage

Account Registration
To use certain parts of the Site, you will need to create an account. You may only have one open account at any given time.

You are responsible for ensuring that all submitted information is complete and accurate. You also agree to keep your information up to date and make timely corrections to the information you have submitted as needed.

If you register for an account to access Site features or services, you are responsible for all actions taken under your account. You agree to keep your login credentials confidential and ensure that no one else uses your username or password. If you believe your credentials may have been compromised or believe that information about you has been incorrectly processed, please contact us immediately.

Use of Site
By accessing or using the Site, you agree to:

(a) Comply with all applicable laws;
(b) Use our services in accordance with these Terms of Use; and
(c) Protect and keep secure your account and any password or security questions used in connection with your account.

Prohibitions
In addition to the prohibitions set out in these Terms of Use, you agree not to:

(a) Modify, adapt, tamper with, translate, decompile, disassemble or reverse engineer any part of:
(i) the Site; or
(ii) any software or technology used or downloaded from the Site unless expressly authorized in writing by the College;(b) Send spam communications;
(c) Infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(d) Send or otherwise make available to us or through the Site any material that:
(i) is defamatory, harassing or obscene; or
(ii) is illegal, fraudulent, misleading or deceptive;(e) Use the Site for any unlawful purpose or in any way that violates applicable laws;
(f) Engage or communicate with a representative of the College or any party in the course of using the Site in a manner that is offensive, abusive, threatening, obscene or indecent;
(g) Provide or distribute false or misleading information to representatives of the College or any other party in the course of using the Site and the College services;
(h) Use any web crawlers, scripts, robots, or other automated tools or manual process to monitor or copy any information stored on the Site or any personal information without our express written consent;
(i) Attempt to access parts of the Site you are not authorized to access;
(j) Impersonate others or misrepresent your affiliation with any person or entity while using the Site;
(k) Disrupt, damage or interfere with the Site, its servers, networks or other users’ access to the Site; or
(l) Collect or store personal information about other users for unauthorized or unlawful purposes.

Account Suspension and Termination
We may at any time suspend or terminate your account or limit your access to the Site for your failure to comply with these Terms of Use, for providing us with untrue or inaccurate information, for infringement upon our proprietary rights or for another reason.

If we terminate your account and/or access to the services, you may not try to access the Site or your account again without our prior approval.

Official Languages
Our use of English and French in public communications and services is guided by the Official Languages Act and related requirements. These set out when we are required to provide information in both official languages.

Links to Other Websites
This Site may contain links to other websites as well as email links. These links are provided solely as a convenience to you. These other websites are independently developed by parties other than the College and the College assumes no responsibility for the accuracy, currency or reliability of the information contained in such websites. The inclusion of any link to another website does not imply endorsement by the College. Please also note that the information contained on a third-party site that we link may not be subject to the Official Languages Act or the Privacy Act.

Usage of Content Provided on this Site

Site Materials
The College owns or licenses the Site and all data, content, text, graphics, forms, artwork, images, photographs, documentation, and other materials on, or made available through the Site (“Site Materials”), as well as the selection, coordination, arrangement, organization, and enhancement of the Site Materials. Unauthorized use of the Site Materials may violate copyright, and other intellectual property laws.

Proprietary Rights
Except for third-party marks, all names, trademarks, service marks, certification marks, symbols, icons, slogans, or logos appearing on the Site are proprietary to the College or its licensors, or suppliers. Use or misuse of these trademarks or any third-party marks is expressly prohibited. You agree not to remove any proprietary notices, trademarks, or labels on or in the Site or the Site Materials.

Non-Commercial Use
The College grants you limited license to access and make personal use of the Site. You may not download (other than page caching), reproduce, duplicate, copy, sell, resell, modify, or exploit the Site or the Site Materials, in whole or in part, except with the express written consent of the College, or where expressly permitted in these Terms of Use.

All rights not expressly granted here are reserved.

Commercial Use
Unless otherwise noted, you may not sell or modify the Site Materials or reproduce, download, store, exploit, display, publicly perform, distribute, or otherwise use the Site Materials in any way for any public or commercial purpose without our prior written consent.

If you violate any of these Terms of Use, your permission to use the Site Materials automatically terminates and you must immediately destroy any copies you have made of the Site Materials.

Third-Party Content
Some content on this Site may be owned by third-parties and is protected under the Copyright Act and other applicable laws.

Feedback
If you send or transmit any communications, comments, questions, suggestions, or related materials regarding the Site, whether by e-mail or otherwise (collectively, “Feedback”), such Feedback will be considered non-confidential and non-proprietary. You hereby assign to the College all right, title, and interest in, and to the Feedback and you waive any moral rights in the Feedback. The College is free to use the Feedback for any purpose, without attribution or compensation to you. You understand and agree that the College is not obligated to use, copy or distribute the Feedback and you cannot compel the College to do so.

Disclaimers, Liability, and Indemnity

The College is not responsible if information made available on our Site is not accurate, complete, or current.

The College also does not guarantee that the Site will be uninterrupted or secure, that it will be available at any particular time or location or that any defects or errors will be corrected or that the Site will be free of viruses or harmful components.

The College is not responsible for any disruption, security breach, loss, or corruption of data or materials during transmission or when downloaded to any system.

You agree that your use of, or inability to use, the Site is at your own sole risk, and you assume responsibility for any costs associated with your use of the Site. The Site is provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied, statutory or otherwise, including all implied warranties or conditions as to accuracy, completeness, reliability, legality, suitability, privacy, quality, usefulness, merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Limitation of Liability
You agree that the College and its respective officers, directors, employees, agents, contractors, suppliers, service providers, licensors, and representatives will not be responsible for (a) any indirect, consequential, incidental, exemplary, punitive or special damages; or (b) for any damages, whether direct, indirect, consequential, incidental, exemplary, punitive or special, characterized as lost revenue, lost savings, or lost profits arising out of or related to these Terms of Use, even if we know they are possible. Regardless of whether such losses are deemed to be direct or indirect damages, the College will not be liable to you for any damages relating to loss of data.

Indemnity
You agree, to the extent permitted by law, to indemnify, defend and hold harmless the College, and our respective officers, directors, employees, agents, contractors, licensors, suppliers, service providers and representatives from and against any and all complaints, charges, claims, damages, losses, costs, liabilities and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to (a) your access to or use of the Site; (b) your breach of these Terms of Use or any applicable law or regulation; or (c) your negligence or willful misconduct.

Social Media

Social Media Accounts
The College uses social media accounts as an alternative method of interacting with licensees and members of the public and, facilitating access to our information and services.

Social media platforms and their computer servers are managed by a third-party, social media accounts are subject to downtime that may be out of the College’s control. We accept no responsibility for platforms becoming unresponsive or unavailable.

Following, “Favouriting” and Subscribing
Our decision to follow, “like” or subscribe to another social media account does not imply an endorsement of that account, channel, page or site, and neither does sharing (re-tweeting, reposting or linking to) content from another user.

Comments and Interaction
We reserve the right to remove comments and contributions, and to block users as deemed appropriate. We also reserve the right to report users and/or their comments and contributions to third-party social media service providers to prevent or remove the posting of content that is contrary to these Terms of Use, or to the Terms of Service/Use of the third-party social media platform.

General Terms

Governing Law and Jurisdiction
These Terms of Use are governed by the laws of Ontario and the federal laws applicable in Ontario, without regard to conflict of law rules. You agree to submit to the exclusive jurisdiction of the courts of Ontario for the determination of any dispute concerning these Terms of Use.

Interpretation
The headings used in these Terms of Use are included for convenience only and will not limit or otherwise affect these Terms of Use. Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.

Waiver
Our failure to exercise any of our rights, powers or remedies under these Terms of Use or at law, or any delay in doing so, does not constitute a waiver of those rights, powers or remedies.

Severance
A declaration of invalidity or unenforceability of any provision of these Terms of Use by a court of competent jurisdiction will not affect the validity or enforceability of any other provision of these Terms of Use.
