Tribunal Actions - April 2025

Harpreet Saini, of Avalon Immigration Inc., in Brampton, Ontario, Mahr Consultancy Services Inc., and Canhelp Migration Experts Inc. in Edmonton, Alberta, filed a motion seeking leave to file additional evidence, change the method of adjudication, cross-examine the complainant and admit additional documentation related to an upcoming hearing before the Discipline Committee. The College opposed the motion as none of the issues were raised previously at earlier phases of adjudication, despite numerous opportunities to do so. The Discipline Committee dismissed the motion citing the RCIC arguments failed to meet the threshold to successfully grant leave, and allowing such a request would prejudice the College unfairly. The RCIC was ordered to pay costs to the College in the amount of $3,390.

So Yeun Park, of JNS Consultancy Ltd., in Vancouver, British Columbia, had their licence permanently revoked following a finding of professional misconduct. The Discipline Committee found the RCIC was convicted of an offence for knowingly providing a fraudulent letter to a family member to facilitate their entry into Canada and for attempting to counsel misrepresentation, contrary to section 126 of the Immigration and Refugee Protection Act (IRPA). The RCIC failed to disclose their criminal charges in their Annual Renewal Report to the College for more than 3 years. The RCIC entered into an Agreed Statement of Facts and Joint Submission on Penalty with the College related to their violations of the 2019 Code of Professional Ethics and the 2022 Code of Professional Conduct. In addition to the permanent revocation, the RCIC was ordered to pay a fine of $2,500 and pay costs to the College in the amount of $2,500.
